1. General Provisions

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) regulate the relationship between the Buyer and the Seller in the sale of goods by IZOL L&M s.r.o. through the online store www.stercore.eu.

1.2 By submitting an order, the Buyer expressly confirms that he/she has read these GTC, which include the Complaints Procedure as an integral part, and that he/she agrees with them. The Buyer is sufficiently notified of these Terms and Conditions before placing the order and has the opportunity to read them. The language offered for concluding the contract is Slovak.

1.3 Different conditions or general terms and conditions of the Buyer shall not be valid unless otherwise agreed in writing between the Seller and the Buyer.

1.4 Submission of an order by the Buyer is considered a proposal to conclude a purchase contract. The Buyer may place an order by telephone, fax, e-mail, or via the web-shop www.stercore.eu.

1.5 The purchase contract between the Buyer and the Seller is concluded at the moment the Seller confirms the Buyer’s order in writing.

1.6 IZOL L&M s.r.o. reserves the right not to deliver the goods even after written confirmation of the order if it is found that the ordered goods are unavailable. In such a case, the Seller shall immediately contact the Buyer and propose an adequate alternative solution (e.g., other suitable goods with similar parameters). If the Buyer agrees with the proposed solution, such agreement fully replaces the originally concluded contract.


2. Ordering via the Stercore Web-Shop

2.1 The Customer may order any goods from the Seller through the web-shop at www.stercore.eu.

2.2 The Buyer may order goods from the web-shop either one-time or after prior registration.

2.2.1 The Buyer may register on the web-shop page. During registration, the Buyer fills in the form with his/her contact details (e-mail, first name, surname, correspondence address – street, number, postal code, city, country; phone number, fax, and possibly Company ID and Tax ID). During registration, the Buyer creates a username and password (hereinafter “login details”), which will allow re-login without re-entering contact details.

2.2.2 The Buyer may also place a one-time order. After selecting the desired goods, the Buyer clicks on “Order”, fills in the e-mail and unchecks “I want to register”. The Buyer then fills in the required data and clicks “Submit”. In this case, the Buyer will need to re-enter the contact details for any future order.

2.3 Data provided by the Buyer to IZOL L&M s.r.o. are subject to the rules set forth in Article 7 of the GTC.

2.4 In the web-shop, the Buyer selects goods via the “Add to Cart” button.

After pressing “Add to Cart”, the goods are automatically added to the shopping cart. The Buyer can view the cart anytime by clicking “View Cart” in the top right corner. The Buyer can still continue shopping by clicking “Continue Shopping”.

2.5 At order confirmation, the Buyer chooses the payment method and delivery method.

2.6 By pressing “Order” in the shopping cart, the order is registered in the system and a confirmation of successful processing will appear.

2.7 The concluded contract is archived by the Seller for the purpose of successful fulfillment and is not accessible to third parties.

2.8 The Buyer may review and correct the order before submitting it.

2.9 These Terms and Conditions are displayed on www.stercore.eu and can be archived and reproduced by the Buyer.

2.10 The Seller undertakes to archive the purchase contract in electronic form together with the applicable GTC for 3 years from the date of order. Such archived contracts are not accessible to the Buyer.


3. Payment Terms

3.1 IZOL L&M s.r.o.s usually delivers goods via postal COD (cash on delivery) or courier COD.

3.2 In case of COD, the Buyer pays upon delivery. For foreign orders, payment is required in advance to the account or via PayPal.

3.3 All prices include VAT and are final. The minimum order value is €10 incl. VAT.

3.4 The Buyer may check the status of orders at any time in the web-shop.

3.5 IZOL L&M s.r.o. may, if the Buyer is a long-term customer, deliver goods via invoice payment. The invoice must be paid by the due date. If the Buyer delays payment, the Seller may charge late interest of 10% p.a. Payment of late interest does not affect the Seller’s right to compensation for damages.

3.6 The price is binding at the moment the confirmation e-mail is sent to the Buyer’s address.


4. Delivery of Goods

4.1 The Seller undertakes to deliver ordered goods to the address provided by the Buyer.

4.2 Goods marked “in stock” are usually delivered within three business days of order confirmation (see 3.6 GTC) or receipt of payment.

4.3 Goods marked “on order” have an individual delivery time depending on supplier availability.

4.4 Goods purchased online will be delivered by courier. Each delivery includes an invoice (tax document), which also serves as a delivery note.

4.5 If delivery is unsuccessful and the parcel is returned, the Seller may re-deliver after agreement with the Buyer, at the Buyer’s expense.

4.6 Risk of damage passes to the Buyer upon receipt. The Buyer (or authorized representative) must check the package upon delivery, note any external damage in the carrier’s protocol, and immediately inform the Seller. Otherwise, claims for transport damage cannot be accepted.

4.7 Delivery times are indicative and non-binding unless agreed in writing.

4.8 The goods remain the property of IZOL L&M s.r.o. until full payment.


5. Right of Return and Withdrawal from the Contract

5.1 Within 7 business days of receipt, the consumer may withdraw without giving a reason, in accordance with §12 Act No. 108/2000 Coll. on Consumer Protection in Doorstep and Mail Order Sales, and must return the goods to the Seller.

5.2 The withdrawal and goods must be delivered to the Seller within this period.

5.3 The consumer may unpack and test the goods as in a regular shop but may not use them for several days and then return.

5.4 If conditions are met, IZOL L&M s.r.o. will refund the paid price by bank transfer within 15 days.

5.5 Goods returned by COD will not be accepted. Insurance of goods is recommended.

5.6 The consumer may also withdraw within 7 days if:
a) the goods have manufacturing defects,
b) the goods were damaged by the Seller.
In such cases, the Seller bears the return costs.

5.7 Further details are governed by the Complaints Procedure.


6. Warranty Period

6.1 The Seller provides a 24-month warranty on CDs and other music media.

6.2 Warranty starts on the date of receipt by the Buyer.

6.3 Discounted goods have at least 12 months warranty, excluding defects for which the price was reduced.

6.4 Complaints follow the Seller’s Complaints Procedure. Place of complaint: IZOL L&M s.r.o..

6.5 The Buyer must submit goods with documentation and invoice.

6.6 Replacement during warranty is free of charge.

6.7 Warranty does not cover defects caused by:
a) mechanical damage,
b) unsuitable conditions (dust, humidity, strong magnetic fields),
c) aggressive chemicals,
d) improper use/handling,
e) incorrect assembly,
f) unsuitable accessories or alteration,
g) neglect of care,
h) unauthorized intervention,
i) incorrect voltage,
j) natural wear and tear.


7. Protection of Personal Data

7.1 The Seller declares all personal data confidential, used only for contract fulfillment, and not disclosed except for distribution/payment purposes.

7.2 Personal data are collected, processed, and stored under Slovak law, in particular Act No. 428/2002 Coll. on Protection of Personal Data.

7.3 The Buyer consents to the collection and processing of personal data until written objection.

7.4 The Buyer has the right to access, correct, and exercise legal rights regarding their data.


8. Final Provisions

8.1 These GTC are governed by Slovak law.

8.2 Any disputes shall be resolved before Slovak courts.

8.3 If any provision is invalid, the validity of the remaining provisions is unaffected.

8.4 The Buyer acknowledges the Seller may amend these GTC.

8.5 No provision of these GTC obliges the Buyer beyond Slovak law.

8.6 These GTC are valid from [01.04.2013].


2. COMPLAINTS PROCEDURE FOR CUSTOMERS

1. Introduction

1.1 The Seller is responsible for product defects, and the Buyer must file a complaint immediately according to this procedure.

1.2 Complaints can be filed:
a) in person at:

b) by post to the same address.

1.3 The Buyer may claim warranty if the goods:
a) have defects caused by the manufacturer or Seller,
b) are under warranty,
c) were purchased from the Seller.

1.4 During warranty, the Buyer is entitled to free defect removal upon presenting goods with accessories, documentation, manual, and warranty card.

1.5 For postal complaints, the Buyer must send a brief defect description.

1.6 The Seller must issue confirmation of receipt of goods for complaint handling.


2. Customer Rights and Obligations

2.1 The Buyer must inspect goods and packaging immediately upon delivery. If damaged, notify the carrier and check the goods in their presence.

2.2 If damaged, the Buyer must record the extent/nature of damage (damage report) confirmed by the carrier.

2.3 The Buyer is not obliged to accept damaged goods. The Seller must be informed immediately (by phone or e-mail).

2.4 The carrier is liable for transport damage since all goods are insured.

2.5 If the Buyer refuses damaged goods, the Seller will send new goods.

2.6 Hidden mechanical defects must be reported immediately, no later than 24 hours after delivery. Later complaints will not be accepted.

2.7 Before first use, the Buyer must read the warranty terms and manual and follow them.


3. Complaint Handling

3.1 If the defect is removable, the Seller will repair the goods or have them repaired by an authorized service.

3.2 If the defect does not prevent use, the Seller may agree on a discount instead. In this case, the defect cannot be claimed again.

3.3 If none of the above applies, the purchase price will be refunded.

3.4 If the defect is irremovable and prevents use, or if multiple defects occur, the Seller will offer replacement with the same or similar goods, or refund the price.

3.5 The Buyer may request replacement instead of repair if this does not cause unreasonable costs.

3.6 The Seller may replace goods instead of repair if no major inconvenience is caused.

3.7 Warranty does not cover defects caused by:
a) mechanical damage,
b) unsuitable conditions (dust, humidity, magnetic fields),
c) aggressive chemicals,
d) improper use/handling,
e) incorrect assembly,
f) unsuitable accessories or alterations,
g) neglect of care,
h) unauthorized intervention,
i) incorrect voltage,
j) natural wear and tear.

In such cases, the Buyer must cover service costs.


4. Complaint Processing Time

4.1 The Seller must process complaints within 30 days of filing. Otherwise, the Buyer may withdraw and claim a refund or replacement.

4.2 For valid complaints, the warranty period is extended by the handling time.

4.3 For invalid complaints, the warranty is not extended.

4.4 If goods are replaced, any new complaint is considered the first complaint.

4.5 The Seller must inform the Buyer of the complaint result (by phone or e-mail) and issue confirmation of when the complaint was filed, repair carried out, and its duration.

4.6 After processing, goods are automatically sent back or may be collected personally. The method may be agreed with the Buyer.


5. Validity of the Complaints Procedure

5.1 This Complaints Procedure is valid from [01.04.2013].

5.2 These provisions fully replace all previous Complaints Procedures.
